Google sues Kyiv developer to get the NEST brand

Google has filed a lawsuit against a major Kyiv real estate developer, “Capital Real Estate” (“Nerukhomist stolytsi”), and Ukrpatent (Ukrainian Intellectual Property Institute) in the Economic Court of Kyiv. It is demanding to annul the certificates issued for the NEST brand.

According to dev.ua, the Nest brand registered with Ukrpatent is the same as Google Nest, which offers smart home solutions.

Google’s US office has filed a lawsuit demanding to annul the certificates issued to the real estate developer “Capital Real Estate” (“Nerukhomist stolytsi”) for the NEST brand for two classes of goods and services:

  • Class 37: installation of equipment; security systems (security alarms, video, and tele-surveillance, access control); installation, repair, and maintenance of air conditioning, ventilation, and heating equipment; installation and maintenance of ventilation, air-conditioning, and refrigeration systems.
  • Class 42: development and design of computer hardware and software; computer graphics; maintenance and creation of websites for customers; website hosting and support.

About the Nest Brands

Google Nest is a line of smart home products, including smart speakers, smart displays, streaming devices, etc. Google Nest appeared after Google acquired Nest Labs for $3.2 billion in 2014. Since May 2019, all Google Home electronics have been sold under the Google Nest brand.

“Capital Real Estate” (“Nerukhomist stolytsi”) has registered and used the NEST brand since 2007. The company itself is owned by Vsevolod Trofimenko, has been on the market since 1997, and is engaged in the construction and maintenance of office centers and residential buildings.
